Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Outale POS service. By creating an account or using the service, you agree to these Terms.

1. Acceptance

By registering for or using Outale POS, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the service.

2. Service Description

Outale POS is a cloud-based, browser-accessible Software-as-a-Service (SaaS) point-of-sale platform for restaurants, cafes, and retail businesses. We reserve the right to modify, update, or discontinue features with reasonable notice.

3. Account Registration

Accounts are created via Clerk. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately via WhatsApp if you suspect unauthorised access.

4. Subscription & Payment

Plans and monthly prices (in Qatari Riyal) are those published on the Restaurant and Retail pricing pages at outale.com at the time you subscribe. Subscriptions are activated and renewed through agreement with the Outale team via WhatsApp. Payment is due at the start of each billing period. Accounts not settled within 7 days of the due date may be suspended. Prices are in QAR and include applicable taxes as required by Qatari law.

5. Acceptable Use

You must not use Outale POS for any unlawful purpose, attempt to reverse-engineer or decompile the software, gain unauthorised access to other accounts or systems, or resell access to the platform without our prior written consent.

6. Intellectual Property

Outale owns all rights to the software, trademarks, and content of the platform. You retain full ownership of your business data (products, orders, employees, etc.) entered into the system.

7. Data & Privacy

We process your personal data as described in our Privacy Policy. You are responsible for ensuring that any data you enter into Outale POS is accurate and lawfully obtained.

8. Service Availability

We aim to keep Outale POS highly available, but we do not guarantee 100% uptime. Planned maintenance will be announced via the in-app Announcement Banner in advance. We are not liable for losses caused by unplanned outages.

9. Limitation of Liability

To the maximum extent permitted by Qatari law, Outale's total liability for any claim arising from these Terms is limited to the subscription fees you paid in the 3 months immediately preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages.

10. Termination

You may cancel your subscription at any time by contacting us via WhatsApp. Cancellation takes effect at the end of the current billing period. Outale may suspend or terminate your account for non-payment (after the 7-day grace period), material breach of these Terms, or if required by law. Upon termination, you will have 30 days to export your business data before it is permanently deleted.

11. Modifications to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via the in-app Announcement Banner or WhatsApp. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Qatar. Any disputes arising from or related to these Terms are subject to the exclusive jurisdiction of the courts of Doha, Qatar.
